1. Introduction and Acceptance

Welcome to LekkerLaw, a service operated by Bruwer Industries (Pty) Ltd (Registration Number: 2024/746121/07), with registered address at 111 Main Road, Strand, 7140, South Africa ("LekkerLaw", "we", "us", or "our").

By accessing or using our website at lekkerlaw.co.za (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Platform.

These Terms constitute a legally binding agreement between you ("User", "you", or "your") and Bruwer Industries (Pty) Ltd, governed by the laws of the Republic of South Africa.

2. Nature of Service

2.1 Platform Service Only

LekkerLaw operates exclusively as a referral and matching platform. We connect individuals seeking legal assistance with registered law firms in South Africa.

We are NOT a law firm and do NOT provide legal services, legal advice, or legal representation of any kind. All legal services are provided directly by independent law firms that are registered with the Legal Practice Council of South Africa.

2.2 Independent Contractors

All law firms on our Platform operate as independent contractors. They are not employees, agents, partners, or joint venture partners of LekkerLaw. We do not:

  • Control how law firms provide their legal services
  • Guarantee the quality, timeliness, or outcome of any legal services
  • Make any representations or warranties about individual law firms
  • Accept liability for the acts, omissions, or negligence of any law firm

2.3 No Legal Advice

Nothing on our Platform constitutes legal advice. Any information provided on our Platform is for general informational purposes only and should not be relied upon as legal advice. For legal advice specific to your situation, you must consult directly with a qualified legal professional.

3. How Our Service Works

When you use our Platform, you:

  1. Provide information about your legal matter through our questionnaire
  2. Consent to us sharing this information with up to 3 matched law firms
  3. Receive contact from these law firms directly with quotes or consultations
  4. Evaluate and choose which law firm (if any) to engage with
  5. Enter into a separate agreement directly with your chosen law firm

LekkerLaw's role ends when we connect you with matched law firms. All subsequent interactions, agreements, and services are solely between you and the law firm.

4. User Responsibilities

4.1 Accurate Information

You agree to provide accurate, complete, and truthful information when using our Platform. Providing false or misleading information may result in inaccurate matching or termination of your access to our services.

4.2 Acceptable Use

You agree not to:

  • Use the Platform for any unlawful purpose or in violation of these Terms
  • Attempt to gain unauthorized access to our systems or networks
  • Interfere with or disrupt the Platform's operation
  • Transmit viruses, malware, or other harmful code
  • Scrape, copy, or harvest data from the Platform without permission
  • Impersonate any person or entity
  • Use the Platform to spam, harass, or send unsolicited communications

4.3 Professional Conduct

You agree to communicate professionally and respectfully with law firms contacted through our Platform. Abusive, threatening, or inappropriate behavior may result in termination of your access.

5. Fees and Payment

Use of the LekkerLaw Platform is currently free for users seeking legal services. We do not charge users for matching them with law firms.

Law firms may charge their own professional fees for legal services provided. These fees are negotiated directly between you and the law firm and are completely separate from our Platform.

6. Limitation of Liability

6.1 Platform Liability

To the maximum extent permitted by South African law, LekkerLaw's liability is limited to providing the referral and matching service only. We are not liable for:

  • The quality, accuracy, timeliness, or outcome of any legal services provided by law firms
  • Any acts, errors, omissions, representations, warranties, breaches, or negligence by any law firm
  • Any dispute between you and a law firm regarding fees, services, or outcomes
  • Any loss or damage arising from your use of legal services obtained through our Platform
  • Any indirect, consequential, special, or punitive damages

6.2 Consumer Protection Act Compliance

In accordance with the Consumer Protection Act, 2008 (Act No. 68 of 2008):

Nothing in these Terms excludes or limits our liability for gross negligence, fraud, or intentional misconduct.

These liability limitations are reasonable and apply to the extent permitted by law. We have drawn your attention to these limitations in plain language as required by South African consumer protection legislation.

6.3 "As Is" Service

Our Platform is provided "as is" and "as available" without warranties of any kind, either express or implied, except where such exclusion is prohibited by law. We do not warrant that the Platform will be uninterrupted, error-free, or completely secure.

7. Indemnification

You agree to indemnify, defend, and hold harmless Bruwer Industries (Pty) Ltd, its directors, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Platform
  • Your violation of these Terms
  • Your violation of any applicable laws or regulations
  • Your relationship or dispute with any law firm

8. Intellectual Property

All content on the Platform, including text, graphics, logos, designs, software, and compilation of content (the "Content"), is the property of Bruwer Industries (Pty) Ltd or its licensors and is protected by South African and international intellectual property laws.

You may not reproduce, distribute, modify, create derivative works, publicly display, or otherwise use our Content without our express written permission.

"LekkerLaw" and our logo are trademarks of Bruwer Industries (Pty) Ltd. You may not use these marks without our prior written consent.

9. Privacy and Data Protection

Our collection, use, and protection of your personal information is governed by our Privacy Policy, which complies with the Protection of Personal Information Act, 2013 (POPIA).

By using our Platform, you consent to our collection and use of personal information as described in our Privacy Policy. Please review our Privacy Policy to understand how we handle your data.

10. Service Modifications and Termination

10.1 Modifications

We reserve the right to modify, suspend, or discontinue any aspect of the Platform at any time, with or without notice. We may also update these Terms periodically. Continued use of the Platform after changes constitutes acceptance of the modified Terms.

10.2 Termination

We may terminate or suspend your access to the Platform immediately, without prior notice, if you breach these Terms or engage in conduct that we deem inappropriate or harmful to our Platform, other users, or law firms.

11. Electronic Communications and Transactions

In accordance with the Electronic Communications and Transactions Act, 2002 (ECTA), you consent to receive communications from us electronically. We will communicate with you by email or by posting notices on our Platform. You agree that all agreements, notices, and other communications provided electronically satisfy any legal requirement that such communications be in writing.

12. Dispute Resolution

12.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law provisions.

12.2 Jurisdiction

Any dispute arising from or related to these Terms or the Platform shall be subject to the exclusive jurisdiction of the South African courts, with the Magistrate's Court or High Court having jurisdiction depending on the nature and value of the claim.

12.3 Alternative Dispute Resolution

Before pursuing formal legal action, we encourage you to contact us to attempt to resolve any disputes informally. We are committed to resolving disputes in good faith.

13. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable under South African law, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

14. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Bruwer Industries (Pty) Ltd regarding your use of the Platform and supersede all prior agreements and understandings.
