Small Claims Court: Suing Without a Lawyer
Owed money? The Small Claims Court is a free, quick way to resolve disputes up to R20,000 without needing an attorney.
What is the Small Claims Court?
It is a court designed for minor civil disputes. Lawyers are not allowed. You represent yourself.
Jurisdiction (The Limit)
As of the latest adjustment, you can claim up to R20,000. If your claim is R25,000, you can "abandon" R5,000 to fit into the Small Claims jurisdiction.
The Process
1. Letter of Demand
You must send the person a letter giving them 14 days to pay. Send it via registered post or hand delivery (get a signature).
2. Summons
If they don't pay, take your proof of delivery and the letter to the Clerk of the Court. They will help you issue a summons.
3. The Hearing
On the court day, bring all your evidence (contracts, invoices, messages). The Commissioner (usually a senior attorney volunteering) will ask questions and make a ruling. The decision is final and cannot be appealed (only reviewed for gross irregularity).
